Please come during the times scheduled to discuss the farm. BigIron Representatives will be there to assist buyers with registering to bid online. You do not have to be present to bid online.
Tract #2 is the E ½ of W ½ 25-34-40 and the E ½ 25-34-40 less a 20 acre tract on the north side of the legal. The tract is south of Road F and begins approximately a quarter mile east of county paved Road 24. There is 457.18 acres in the tract comprising 440.89 acres cropland and 16.29 acres noncropland. Soils are 372.1 acres Dalhart Loamy Fine Sand 3-5% slope; 57.8 acres Bigbow Loamy Fine Sand 0-3% slope; and 23.1 acres Eva Loamy Fine Sand 3-8% slope.
There is 287.83 acres of pivot irrigated cropland and 153.06 acres dry cropland per FSA maps. There is one water right #41785, priority date 7-17-1995, authorizing irrigation of 280 acres with an authorized quantity of 420 acre feet at an authorized rate of 970 gpm. The well was pumping 600 gpm in 2016 per the owner. Of the 280 acres authorized to be irrigated, 147 acres are authorized north of the half mile line, and 133 acres south of the half mile line. The pivot as placed on the land has an estimated 80 acres of actual irrigated acres north of the half mile line, and 200 acres of actual irrigated acres south of the half mile line. The buyer will need to make an ‘application to change the place of use’ with the Kansas Division of Water Resources (DWR) to distribute the 280 acres authorized to match how the pivot is physically laid out north and south of the half mile line. This is not expected to be a problem, but needs to be done. Prospective buyers should research this with the DWR and Groundwater Management District #3 (GWMD#3) both in Garden City, KS.
As stated in the Tract #1 description above, an irrigation water ‘place of use overlap’ exists between Tract #1 & Tract #2 meaning water can be moved between the Tracts limited to authorized acres and quantities. Buyers are responsible for verifying the accuracy of this with the DWR and GWMD#3. The irrigation systems in Tract #1 and Tract #2 are tied together with underground pipe. Tract# 2 has a 12 tower T&L circle irrigation system powered by a 200HP electric motor variable speed. Electric power comes in from the south side of the section.

Terms
The successful high buyer will be notified by a BigIron Realty agent at the conclusion of the auction and will be required to enter into a written purchase agreement with 15% down payment to be bank wired within 48 hours of the close of the auction. The balance will be due at closing on or before December 8, 2017. Buyer will receive full possession on the date of closing, subject to tenant rights. Seller will provide marketable title to the buyer evidenced by Title Insurance. The current year real estate taxes will be paid by the Seller and 2018 Real Estate Taxes paid by the Buyer. Property will not be sold subject to financing. Please have all financial arrangements made prior to the auction. The written purchase agreement to be signed by the seller and buyer after the auction is the sole and controlling document of this sale and supersedes any and all other terms whether verbal, written, expressed or implied and shall be the sole and controlling document for this real estate transaction.
